Eligibility and lawful use
By using cybroko services you represent that you have the legal capacity and authority to enter into these terms on behalf of yourself or the organization you represent. Services are intended for business, professional, and organizational use.
Users must meet any minimum age or legal capacity requirements under applicable law in Thailand to form valid contracts. Minors are not authorized to form agreements without appropriate legal guardianship.
You agree to use services only for lawful purposes and in a manner consistent with these terms. Prohibited uses include activities that would violate applicable law, infringe third-party rights, or harm cybroko systems and users.
Access to our services may be limited or restricted in certain jurisdictions. It is your responsibility to ensure compliance with local import, export, and data transfer laws relevant to your use of cybroko.
Account and access
Some cybroko services require registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
You must provide accurate and complete information during registration and keep it up to date to ensure effective service delivery and communication.
Take reasonable measures to protect your account, including using strong passwords and enabling available security features. Notify us promptly if you suspect unauthorized access.
Accounts and associated rights are personal and non-transferable without prior written consent from cybroko, except as required by law or organizational assignment agreements.
If you believe your account has been compromised, contact cybroko immediately at the address listed in these terms so we can take appropriate remedial steps.
We may suspend or restrict access to accounts that violate these terms, present security risks, or are subject to legal process. Suspensions will be communicated with reasons where permitted.
Services and deliverables
cybroko provides custom software development, integration, maintenance, and advisory services. Scope, timelines, and deliverables are defined in project-specific statements of work or contracts.
Project scopes may be adjusted through mutual written agreement. Changes that affect cost or timeline will be documented in change orders and require client approval before implementation.
We strive to deliver services consistently but availability can be affected by maintenance, force majeure, or third-party dependencies. Service level expectations are contract-specific and should be defined in the statement of work.
User conduct and rules
To maintain a professional environment, users must follow these rules while using cybroko services and platforms.
- Do not attempt unauthorized access or testing that could compromise system integrity.
- Do not submit content that infringes intellectual property, is illegal, or is abusive toward individuals or groups.
- Follow prescribed development and deployment processes to maintain security and reliability.
- Respect confidentiality obligations and do not disclose proprietary project information without authorization.
- Use provided environments only for agreed purposes and do not introduce malicious code or vulnerabilities.
- Cooperate with incident response and remediation requests from cybroko to address security or operational issues.
- Provide accurate business requirements and feedback to support effective delivery and reduce rework.
User content and submissions
You may provide content, data, or materials for use in projects or hosted services. Ownership and responsibilities are set out below.
You retain ownership of data and content you submit, subject to any license granted to cybroko to perform services. Ownership transfers must be explicitly agreed in writing.
By submitting content, you grant cybroko a limited, non-exclusive license to use, reproduce, and process the materials as necessary to deliver contracted services, including testing and deployment.
You are responsible for ensuring that submitted content complies with applicable laws and does not violate third-party rights. Ensure you have necessary rights and consents for data processed by cybroko.
Requests to remove user-submitted content will be evaluated, and removal will be executed when consistent with contractual obligations, legal requirements, and operational constraints.
Intellectual property
cybroko and its licensors retain intellectual property rights in pre-existing code, tools, methodologies, and configurations used to deliver services. Client-specific deliverables and ownership depend on contractual arrangements.
- Do not copy or use cybroko proprietary tools or internal frameworks outside of the terms agreed in writing.
- Respect third-party licensed components integrated into delivered software and adhere to applicable license terms.
- Any use of our activity or branding requires prior written consent from cybroko.
Paid services and billing
Paid services include development projects, support subscriptions, and managed services. Commercial terms are documented in proposals and agreements.
Pricing is set per project or subscription. Estimates are based on defined scope and assumptions; changes in scope may affect final pricing.
Invoices are issued according to the payment schedule in the contract. Payment terms, accepted currencies, and methods are specified in each agreement.
Subscription services renew as set out in the contract. Cancellation and renewal terms are governed by the subscription agreement.
Refunds, if any, are handled per the terms agreed in the contract. Refunds are considered where appropriate based on service failures or contractual remedies, not as an automatic policy.
Cancellation requests should follow the process in your agreement. Early termination may incur fees or obligations for work performed to date.
Clients are responsible for applicable taxes, duties, and withholding as required under local law unless otherwise stated in the agreement.
Price adjustments for ongoing services will be communicated in advance and require client acceptance where contractually necessary.
Non-payment may result in suspension of services and accrual of interest or collection costs as set out in the applicable agreement.
Disclaimer
cybroko provides services based on professional expertise and documented requirements. Outcomes depend on multiple factors including data quality, client inputs, and external systems. We provide guidance and deliverables consistent with the agreed scope and professional standards.
Limitation of liability
To the fullest extent permitted by law, cybroko's liability for direct damages arising from its services is limited to the fees paid for the specific services giving rise to the claim. We are not responsible for indirect, consequential, or predictive losses.
Third-party services
Third-party software or services used in projects are governed by their respective licenses and terms. cybroko will identify such components and assist with compliance but is not liable for third-party service failures.
Termination and suspension
Either party may terminate the contract for material breach if the breach is not remedied within the agreed cure period. Termination for convenience is subject to contract terms and any applicable fees.
Upon termination, outstanding fees for work performed become due. We will provide reasonable assistance for transition and handover of deliverables as specified in the agreement.
Privacy and data protection
Personal data processing is governed by our Privacy Policy. Data handling, security measures, and user rights are set out to ensure responsible processing in the context of our services.
Communications
We may communicate important service notices, billing information, and security updates via email or other contact methods you provide. Ensure contact information is accurate to receive timely communications.
Changes to terms
We may update these terms when necessary. Significant changes will be notified in advance. Continued use after changes constitutes acceptance where allowed by law.
Applicable law
These terms are governed by the laws applicable to the party agreements and service location. For services delivered in Thailand, Thai law and competent courts may apply unless otherwise agreed in writing.
Dispute resolution
Parties will attempt to resolve disputes through negotiation and mediation before pursuing litigation. Contractual dispute resolution procedures in the agreement take precedence.
